1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the ReadyToSell.com website (the "Site") and the ReadyToSell SMS educational program (the "Program"), both offered by Unplugged Media LLC dba ReadyToSell ("ReadyToSell," "we," "us," or "our"). By accessing the Site or opting into the Program, you agree to be bound by these Terms. If you do not agree, do not use the Site or the Program.

2. Our Services — What We Are (and Are Not)

ReadyToSell is a free educational resource. We publish prep tips, timing alerts, market context, and general information to help homeowners prepare to sell. We are not a real estate agent, broker, salesperson, or licensed advisor in any jurisdiction. We do not represent buyers or sellers in real estate transactions. We do not negotiate or broker deals on your behalf.

By using the Site or the Program, you acknowledge that no agent–client, broker–client, attorney–client, fiduciary, or advisory relationship is created between you and ReadyToSell. You remain solely responsible for your own real estate, legal, and financial decisions.

3. SMS Program Terms

When you opt into the Program by submitting your mobile number through the Site, you expressly consent to receive recurring automated marketing text messages (SMS/MMS) from ReadyToSell at the number you provide. Specifically:

• Consent is not a condition of any purchase.
• Message frequency varies.
• Message and data rates may apply. Your carrier's standard rates will apply.
• Reply HELP at any time for help.
• Reply STOP at any time to cancel. You will receive one final confirmation message.
• Carriers (AT&T, T-Mobile, Verizon, Sprint, and others) are not liable for delayed or undelivered messages.

You represent that the mobile number you submit belongs to you and that you have the authority to receive messages on it. If you change or lose access to that number, it is your responsibility to opt out and update.

4. Educational Content — No Professional Advice

All content delivered through the Site, the Program, and any related channels is provided for general educational purposes only. It is not, and should not be relied upon as, real estate, legal, tax, accounting, or financial advice. Real estate transactions, tax treatment, and legal obligations vary by state, municipality, and individual circumstances.

5. User Conduct

You agree not to:

• Use the Site or the Program for any unlawful purpose.
• Submit false, misleading, or fraudulent information, including someone else's phone number without authorization.
• Interfere with the operation of the Site or attempt to gain unauthorized access.
• Use any automated means (scrapers, bots) to access the Site or harvest content.
• Reproduce, distribute, or commercially exploit our content without written permission.

6. Intellectual Property

All content on the Site — including text, graphics, logos, design, articles, tools, and underlying code — is owned by Unplugged Media LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use only.

7. Disclaimer of Warranties

THE SITE AND THE PROGRAM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT CONTENT WILL BE ACCURATE OR COMPLETE, THAT THE SITE WILL BE SECURE OR ERROR-FREE, OR THAT RESULTS FROM TOOLS (e.g., THE HOME SALE ESTIMATOR) WILL MATCH ACTUAL OUTCOMES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNPLUGGED MEDIA LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR ECONOMIC LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR THE PROGRAM. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THE PROGRAM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Unplugged Media LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site or Program, (b) your violation of these Terms, or (c) your violation of any rights of a third party.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws provisions. Any action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts.

11. Changes to These Terms

We may modify these Terms at any time by posting a revised version on the Site and updating the "Last updated" date above. Continued use of the Site or the Program after changes take effect constitutes your acceptance of the revised Terms.
